2. Applicability (B2C and B2B) These terms apply to both individual consumers (B2C) and business customers (B2B).

  • For individual consumers, purchases are governed by the Swedish Consumer Purchases Act (Konsumentköplagen) and the Distance Contracts Act (Distansavtalslagen).

  • For business customers (wholesale/HoReCa), purchases are governed by the Swedish Sale of Goods Act (Köplagen). Custom wholesale agreements may supersede these general terms.

3. Products and Food Safety We specialize in imported, premium dried and cured Mediterranean seafood. While we strive to display product colors, sizes, and textures accurately, natural food products may have slight variations. We guarantee that all products meet EU and Swedish food safety standards at the time of dispatch. It is the buyer's responsibility to store the products correctly (in a cool, dry place) once delivered.

4. Pricing and Payment All prices on the website are listed in [Select: SEK / EUR] and [Select: include / exclude] Value Added Tax (VAT/Moms). Shipping costs are calculated at checkout and are not included in the base product price. We reserve the right to adjust prices at any time without prior notice; however, the price displayed at the time of your order confirmation will always apply to that specific order.

5. Orders and Contract An order is only legally binding once we have sent an official Order Confirmation to your email address. We reserve the right to cancel any order due to inventory shortages, suspected fraud, or pricing errors on the website. In such cases, a full refund will be issued immediately.

6. Shipping and Delivery We ship within [Sweden / the EU]. Estimated delivery times are provided at checkout. While we strive to meet all delivery estimates, Hanabal Seafood is not liable for delays caused by the shipping carrier, customs clearances, or exceptional circumstances beyond our control.

  • B2B/Wholesale: The risk of loss transfers to the business buyer once the goods are handed over to the freight carrier (FCA/EXW, unless otherwise agreed).

7. Returns and Right of Withdrawal Due to strict food safety and hygiene regulations, all sales of food products (including dried seafood and bottarga) are final. The standard 14-day right of withdrawal (ångerrätt) under Swedish law does not apply to food items or products with broken seals. Please refer to our Return & Refund Policy for detailed instructions on how to handle damaged or defective goods (reklamation).

8. Limitation of Liability Hanabal Seafood is not liable for any indirect, incidental, or consequential damages arising from the use of our products or website. For business customers (B2B), our maximum liability is strictly limited to the total purchase price of the specific order in question.

9. Force Majeure Hanabal Seafood is exempt from fulfilling its obligations under these terms if prevented by circumstances beyond our reasonable control (Force Majeure). This includes, but is not limited to, government interventions, new/amended legislation, strikes, fires, floods, sabotage, major transportation disruptions, or supply chain failures.

10. Privacy and Personal Data Your submission of personal information through the store is governed by our Privacy Policy, which complies with the EU General Data Protection Regulation (GDPR). We only collect data necessary to process your orders and improve your shopping experience.

11. Governing Law and Dispute Resolution These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of Sweden.

  • Consumers: In the event of a dispute, we comply with the recommendations of the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden - ARN). You may also use the EU Online Dispute Resolution (ODR) platform.

  • Businesses: Disputes between Hanabal Seafood and business customers shall be settled by the general courts of Sweden, with the District Court of Gothenburg (Göteborgs tingsrätt) as the court of first instance.
